Insurance/Bad Faith – January 6, 2006 Salter v. Baldwin Mutual Ins. Co. Plaintiffs maintained property damage coverage with defendant. Hurricane Ivan damaged plaintiffs’ house. Plaintiffs alleged that Defendant breached its contract to pay and acted in bad faith by paying an amount far less than the actual loss. Plaintiffs were awarded $4,692 in district court, and Defendant appealed. Plaintiffs amended their complaint to include a claim for personal injury and mental anguish. VERDICT — $60,000 ($40,000 for bad faith and $20,000 punitives).
Premises Liability – December 6, 2005 Allen v. Piggly Wiggly Elderly Plaintiff tripped on pallet left in floor of grocery store. VERDICT — $62,500 for the Plaintiff. (Court granted post-trial JNOV and/or motion for new trial and case settled for $35,000.)
