Insurance Coverage/Homeowner’s Policy – October 19, 2005 Lukich v. State Farm Fire & Casualty State Farm insured Plaintiffs’ home and property in Pelham against loss by fire damage and other perils. A wind and rain storm caused a tree to fall onto the pool deck and into the pool causing considerable damage. Plaintiffs filed a claim with State Farm. Plaintiffs alleged that State Farm failed to evaluate or willfully refused to honor the claim. State Farm filed a summary judgment motion contending that the policy excluded isolated or widespread damage resulting from natural or external forces, or a combination of both, as well as damage to the pool or patio area resulting from pressure or water weight. JUDGMENT — For the Defendant on summary judgment.
Motor Vehicle Accident – December 7, 2005 Wood v. Gradco, Inc. Plaintiff injured in rear-end crash after she stopped for a lawn company truck parked in a blind curve. VERDICT — $150,000 for Plaintiff against Defendant lawn company.
Negligence/Construction Defect – November 18, 2005 Cranford v. Dillard Plastering Plaintiff purchased new home which suffered from latent moisture intrusion, water damage and wood rot due to improperly installed EIFS. VERDICT — $145,000 for the Plaintiff.
